This Circular provides guidance on division of contract packages, formulation of dossiers and procedures for drug procurement at public health facilities.

According to Clause 1 Article 12 of this Circular, contractors shall be sorted according to technical criteria that their drugs satisfy.

If a drug satisfies criteria of more than one category, its supplier may be divided into one or some categories corresponding to the technical criteria their drug satisfies, and provided the bid price for the same drugs in all categories participated by the contractor are consistent.

Upon holding a bidding for drug procurement, the usual direct contracting shall be applied to contract packages worth VND1 billion at most and simplified direct contracting procedures shall be applied to the cases mentioned Point a Clause 1 Article 22 of Law on Bidding and Article 79 of the Decree 63/2014/ND-CP.

The selective bidding shall be applied to any procurement under special control of the Ministry of Health or any procurement of special drugs that can be supplied by few suppliers.

For the contract package value does not exceed VND5 billion and contract package for essential medicines, the competitive offering shall be applied.

For the cases meeting the conditions at Article 23 of this Circular, the direct procurement shall be applied.

This Circular takes effect from October 1st, 2019 and replaces Circular No. 11/2016/TT-BYTstatus1 dated May 11th, 2016.
