In comparison with the earlier provisions, there are some notable changes in subjects of application and types of construction contract

Accordingly, apart from projects using state capital from 30% and over, subjects that are compulsory to comply with this Decree also include projects using state capital from under 30% but over VND 500 billion of total project investment capital

There are also some amendments, supplements regarding types of construction contract such as: to supplement contract for supply of human force, working machinery and equipment (depending on nature of work); to remove the percentage – based contract; to supplement the combined price contract (depending on contractual price manner), etc.

In addition, construction contracts are also classified depending on relationship of parties involved, including: Main contract, sub-contract, fixed rate contract, and foreign construction contract

This Decree shall take effect from June 15, 2015. To replace Decree No. 48/2010/ND-CP dated May 07, 2010 and Decree No. 207/2013/ND-CP dated December 11, 2013.
